A former Santa Maria-Bonita School District assistant superintendent and three former executives of TurnKey Construction company have been indicted by a criminal grand jury on 74 felony counts including misappropriation of public money and embezzlement of public funds, totaling more than ,3.6 million.
Named in the indictment are Cynthia Lynn Clark, 54, former Santa Maria-Bonita assistant superintendent, now of Cape Canaveral, Fla.; Harold Leo Clark III, former TurnKey chief executive officer, 46, of Temecula; Michael Patrick Bannan, former TurnKey chief operating officer, 43, of Vista; and David Irwin, former TurnKey vice president, 39, of Temecula.
The 45-page indictment was unsealed today in Santa Barbara County Superior Court. Arraignment is scheduled for May 19.
The case stems from a three-year investigation into TurnKey by the Special Crimes Unit of the California Department of Justice with assistance from the Santa Barbara County District Attorney?s Office, according to a statement from State Attorney General Edmund G. Brown?s office.
Between 2000 and 2002, TurnKey was awarded a ,62 million construction management contract with the Santa Maria-Bonita School District for 16 school projects, according to the attorney general?s office.
State officials allege that financial records show company executives used district money to pay for expensive cars, artwork, and cash bonuses before the company declared bankruptcy, leaving subcontractors unpaid.
If convicted, the defendants face 38 years in prison.
